Zespół Szkół Ekonomicznych w Nowym Sączu Description Niniejszy artykuł jest próbą zarysu struktury norm prawnych w ustroju państwa. Już w ogólnym znaczeniu struktury zawierają się takie jej atrybuty jak uporządkowanie, organizacja, hierarchia, właściwości i relacje – co pozwala potraktować strukturę (w szczególności normatywną) w ujęciu systemowym. Elementarnym tworzywem tego systemu są normy prawne, czyli reglamentowane komunikaty, które odwzorowują narzucony przez legislatywę porządek prawny. Typizacja źródeł prawa deleguje adresatom tych komunikatów (obywatelom, organom państwowym) pewien schemat postępowania, konstytuujący zasadę legalizmu. Kontrolne kompetencje Trybunału Konstytucyjnego (TK) sprowadzają się do odkodowywania (stwierdzania lub zaprzeczania) praworządności dyrektyw w świetle stosowania norm z przepisów prawa. W artykule położono merytoryczny nacisk na zjawisko sprzężenia norm krajowych z regulacjami (umowami) międzynarodowymi. Poddano pod wątpliwość ukształtowaną praktykę traktowania nowelizacji umów – jako części krajowego porządku prawnego – bez ich każdorazowego wewnętrznego promulgowania. Podano również przykład braku wyraźnego stanowiska (uzasadnienia) TK, jakie było zajmowane w przedmiocie zasady nullum crimen sine lege scripta – zabraniającej kryminalizacji czynów w drodze aktów rangi podustawowej. Abstract (English) This article is an attempt to outline the structure of legal provisions in the state system. In the general sense of the structure, there are such attributes as orderliness, organization, hierarchy, properties and relationships – which allows to regard the structure (particularly in a normative sense) as a systemic approach. Legal norms, or rationed messages are the elementary link of this system, which reflect the legal order imposed by the legislation. The typification of the sources of law gives the recipients of these communications (citizens, state authorities) a certain pattern of behavior, constituting the principle of legalism. The control powers of the Constitutional Tribunal (CT) concentrate on decoding (affirming or denying) the legality of directives in the light of the application of norms stated by the law. The article puts a substantive emphasis on the phenomenon of coupling national standards with the international regulations (agreements). The established practice of treating the amendment of contracts as a part of the national legal order was undermined without any internal promulgation. An example of the lack of a justification of the Constitutional Tribunal was also presented, which was taken into consideration according to the principle of nullum crimen sine lege scripta – which forbids the criminalization of acts by means of subordinate acts.
