Published April 25, 2026 | Version v1 Report Open Research and Protection of Culture in Cyprus: Challenges and Pitfalls of the Cypriot Copyright Legislation Authors/Creators Jougleux, Philippe (Researcher) 1 Show affiliations 1. European University Cyprus Description This expert opinion provides a comprehensive analysis of the legal framework governing research, teaching, and library activities under Cypriot copyright law. The study examines the challenges arising from the current legislative landscape and its interaction with European Union law, and formulates concrete legislative and non-legislative recommendations for reform. The study adopts a structured methodology, beginning with an overview of the historical evolution of Cypriot copyright law — from its British colonial origins through Law 59/1976 and successive waves of EU harmonisation — and a critical assessment of the practical ecosystem in which it operates, including the role of collective management organisations and the institutional architecture of enforcement. It then maps the full catalogue of exceptions and limitations relevant to research, teaching, and libraries, including fair dealing, quotation, private copying, the teaching and e-teaching exceptions, text and data mining, parody, the library and preservation exceptions, public lending, accessibility for visually impaired persons, and the reporting of current events. Each exception is examined in light of the relevant EU acquis, CJEU case law, and the limited Cypriot jurisprudence available. Beyond exceptions, the study explores adjacent mechanisms that shape the research and cultural environment: the 2022 National Open Science Policy, the regimes governing out-of-commerce and orphan works, the absence of a secondary publication right, contractual rules on fair remuneration and transfer of rights, the framework on communication to the public, and the legal regime applicable to technical protection measures. Drawing these strands together, the study concludes with a detailed set of policy proposals, distinguishing between general legislative reform — most notably a tabula rasa re-codification of Law 59/1976 — targeted statutory amendments in the education and research sectors, and non-legislative measures aimed at activating dormant institutions, completing administrative infrastructure, and raising legal awareness among educational and cultural stakeholders.
