Consultancy Services for legal assistance for INTIC

The Government of Mozambique has received financing from the World Bank toward the cost of the Digital Acceleration Project, and intends to apply part of the proceeds for consulting services.
The consulting services ("the Services") include to support the National Institute of Information and Communication Technologies, INTIC, IP, in activities that are directly aligned with the objectives of the MDAP and EDGE Projects. These activities include supporting the formulation and implementation of legal instruments, such as laws, decrees, resolutions, contracts and memoranda. The main focus of the activity is Cyber Security and Data Protection, and other topics related to digital transformation will be addressed on a needs basis, such as E-Commerce, Electronic Transactions, Digital Economy, Internet Governance, Artificial Intelligence; Emerging Technologies, Cloud Computing and other issues relevant to the regulation of the ICT Sector.

The Ministry of Transport and Communications now invites eligible consulting firms ("Consultants") to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are: i) Extensive legal and ICT experience, with a minimum of 10 years' professional experience in providing legal services, especially in the ICT sector, for public and private clients; ii) the firm must have local and International Regulatory acumen: understanding of existing ICT regulatory instruments in the Republic of Mozambique, and knowledge of international regulatory instruments; iii) Specialization in Legal Reform: proven experience in legal reform processes, particularly in developing countries..
The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s "Procurement Regulations for IPF Borrowers" September 2023 ("Procurement Regulations"), setting forth the World Bank’s policy on conflict of interest.
Consultants may associate with other firms to enhance their qualifications, but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.
A Consultant will be selected in accordance with the Quality Based Selection (QBS) method set out in the Procurement Regulations.
