Source Data Summary The Statutory Pay-As-You-Go Act of 2010 (Statutory PAYGO, P.L. 111-139 , 2 U.S.C. §§931-939) is a budget enforcement mechanism intended to ensure that laws affecting direct (mandatory) spending or revenues do not, in aggregate, increase budget deficits. Under the act, the Office of Management and Budget (OMB) is required to maintain two scorecards that record the estimated average annual net effects on the deficit of enacted PAYGO legislation over 5 years and 10 years, respectively. The scorecards are cumulativeâthey keep a running total of net deficit effects across successive sessions of Congress. OMB is required to finalize the scorecards at the end of each congressional session. If either scorecard shows a positive balance in the budget year (a "debit," representing a net increase in the deficit), the President is required to issue a sequestration order within 14 days, implementing across-the-board reductions in non-exempt mandatory spending programs sufficient to eliminate the debit. Since adoption of the Statutory PAYGO Act, laws estimated to increase federal budget deficits have been enacted, but a sequester under the law has never been orderedâan outcome attributable to congressional actions to exclude or eliminate the budgetary effects of legislation from the scorecards. Between 2010 and 2024, nearly $12.07 trillion was excluded or eliminated from the 5-year Statutory PAYGO scorecard and $17.07 trillion was excluded or eliminated from the 10-year scorecard (as measured in nominal dollars) in the following manner: Exclusions provided in the original Statutory PAYGO Act. The 2010 law excluded from the scorecards the budgetary effects of legislation that would extend certain policies current at that time (relating to certain tax policies and Medicare). The law also excluded the projected budgetary savings anticipated from repeal of the Community Living Assistance Services and Supports Act (CLASS Act), and any provision designated by Congress as an emergency. In total, between 2010 and 2025 these original provisions excluded $2.48 trillion from the 5-year scorecard and nearly $2.40 trillion from the 10-year scorecard. Additional provisions included by Congress in new laws. Congress has at times included provisions within a new law (enacted after Statutory PAYGO) that expressly excludedâin whole or in partâthe budgetary effects of that law from the Statutory PAYGO scorecards. In total, between 2010 and 2025, these provisions excluded $4.70 trillion from the 5-year scorecard and nearly $7.83 trillion from the 10-year scorecard. Legislation that eliminated existing balances on the Statutory PAYGO scorecards. Between 2010 and 2025, five laws have been enacted that subtracted nearly $4.88 trillion from the 5-year scorecard and nearly $6.85 trillion from the 10-year scorecard. Because the budgetary effects of certain laws have been excluded from the Statutory PAYGO scorecards, and other laws have eliminated existing balances from those scorecards, the conditions that would trigger a sequester under the act have never been met. Given these results, Congress may consider whether the Statutory PAYGO lawâas currently structuredâis an effective tool for controlling deficits, and whether it should be revised, replaced, or repealed. Statutory PAYGO Act in Brief The Statutory Pay-As-You-Go Act of 2010 (Statutory PAYGO) 1 is a budget enforcement mechanism intended to ensure that laws affecting direct (mandatory) spending or revenues do not, in aggregate, increase budget deficits. The law was enacted as part of legislation that also increased the statutory debt limit. 2 Application of Statutory PAYGO Statutory PAYGO applies to the net, on-budget effects of new mandatory (direct) spending and revenue legislation only. Off-budget and discretionary spending effects are not recorded on the Statutory PAYGO scorecards. Under the act, the Office of Management and Budget (OMB) is required to maintain two scorecards that record the estimated average annual deficit effects of enacted PAYGO legislation over 5 and 10 years, respectively. 3 The OMB scorecards are cumulativeâthey keep a running total of net deficit effects across successive sessions of Congress. With each annual Statutory PAYGO report, the fiscal years on each scorecard advance one year. 4 For this reason, the budgetary effects of enacted legislation may remain on the scorecards and influence balances thereon for up to a decade (unless statutory language directs otherwise). OMB is required to finalize the scorecards at the end of each congressional session. If either scorecard shows a positive balance in the budget year 5 (a "debit" representing a net increase in the deficit), the President is required to issue a sequestration order within 14 days, implementing largely across-the-board reductions of non-exempt mandatory spending programs in an amount sufficient to eliminate the debit. 6 If there is a debit on both scorecards in the budget year, the sequester must be large enough to eliminate the larger of the two amounts. Statutory PAYGO Scorecards Record Estimated Average Annual Net Budgetary Effects Entries on the Statutory PAYGO scorecards reflect the estimated average annual cumulative budgetary effects of new laws on net deficits over 5 and 10 years. Example: For a session of Congress, laws are enacted that would increase net budget deficits by an estimated $10 billion over 5 years and $40 billion over 10 years. The following entries would be recorded on each scorecard: 5-yr scorecard: $2 billion in each year ($10 billion divided by 5 years) 10-yr scorecard: $4 billion in each year ($40 billion divided by 10 years) Exclusions Pursuant to the Original Statutory PAYGO law The budgetary effects of some laws, however, have been excluded from the Statutory PAYGO scorecards. When the Statutory PAYGO Act was enacted in 2010, Congress excluded the budgetary effects of legislation that would extend certain policies deemed "current" at that time: (1) Medicare payments to physicians under the Sustainable Growth Rate formula, (2) the estate and gift tax, (3) the alternative minimum tax, and (4) extension of certain middle-class tax cuts. These adjustments applied only to legislation enacted by the end of 2011. 7 The law also excludes any projected budgetary savings from the Community Living Assistance Services and Supports Act (CLASS Act), a federal long-term care insurance program. 8 The CLASS Act was repealed in 2012, but the exclusion remains. In addition, the act provides that budgetary effects designated as an emergency requirement in law are to be excluded from the Statutory PAYGO scorecards. 9 An example of such designation can be found in Section 2(b)(1) of the Emergency Repatriation Assistance for Returning Americans Act ( P.L. 117-39 ): (b) Emergency Designation.â (1) In General.âThe amounts provided by the amendment made by this section are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You Go Act of 2010 (2 U.S.C. 933(g)). Figure 1 shows how these exclusions influence the amounts recorded on the scorecards and prevent conditions that would trigger an end-of-session sequester. Figure 1. OMB Statutory PAYGO Scorecard for Budget Year 2011 Source: Office of Management and Budget, 2010 Statutory Pay-As-You-Go Annual Report , p. 7. Notes: To calculate the amounts recorded on the 5-year scorecard under the Statutory PAYGO Act, the estimated cumulative budgetary effects of legislation enacted in the second session of the 111 th Congress over the 2010-2015 period ($899,419 million) is adjusted for the exclusions provided in law. The result (a savings of $55,173 million) is then divided by 5 to reflect the annual average ($11,035 million) and recorded as a credit in each year of the 2010-2015 period. To calculate the amounts recorded on the 10-year scorecard, the process is repeated using entries that correspond to the 2010-2020 period. The estimated cumulative budgetary effects of legislation enacted ($820,093 million) are adjusted for the exclusions provided in law. The result (a savings of $63,714 million) is then divided by 10 to reflect the annual average ($6,731 million) and recorded as a credit in each year of the 2010-2020 period. Exclusions Pursuant to Provisions Within New Law At times, Congress has included provisions within a new law (enacted after the Statutory PAYGO Act) that expressly excludedâin whole or in partâthe budgetary effects of that law from the Statutory PAYGO scorecards. An example of this type of exclusion can be found in Section 3106(a) of the Full-Year Continuing Appropriations and Extensions Act, 2025 ( P.L. 119-4 ): (a) Statutory PAYGO Scorecards.âThe budgetary effects of divisions B and C shall not be entered on either PAYGO scorecard maintained pursuant to section 4(d) of the Statutory Pay-As-You-Go Act of 2010. The budgetary effects of these exclusions are never reflected on the scorecards, and their omission influences whether conditions will exist for an end-of-session sequester. Total Budgetary Effects Excluded from the Statutory PAYGO Scorecards Between 2010 and 2025, 82 measures have been enacted in which the budgetary effects, in whole or in part, were excluded from the Statutory PAYGO scorecards. 10 In total, provisions in these measures excluded nearly $7.19 trillion from the 5-year scorecard and $10.22 trillion from the 10-year scorecard (measured in nominal dollars). Of these amounts, a majority can be attributed to two types of exclusions: (1) laws enacted after the Statutory PAYGO Act that contain "within bill" exclusions exemplified by Section 3106 above, and (2) provisions designated by Congress as a emergencies (see Table 1 ). Pursuant to Section 3(4)(A)-(B) of P.L. 111-139 , amounts on the Statutory PAYGO scorecards reflect estimated on-budget mandatory (direct) spending outlays and revenue effects only. Off-budget and discretionary spending effects are not recorded. Positive amounts (costs or "debits") indicate a net increase in the deficit; amounts in parentheses are negative and indicate a net decrease in the deficit (savings or "credits"). The amounts in this table are recorded in nominal dollars. b. This category summarizes the budgetary effects attributable to the current policy exclusions pursuant to Section 4(c) and the CLASS Act exclusion in Section 4(d)(6) of P.L. 111-139 (as discussed in the report) combined. c. This category summarizes the budgetary effects attributable to the exclusion in Section 4(g) of P.L. 111-139 for provisions designated as an emergency. d. This category summarizes the budgetary effects attributable to provisions within a new law (not covered by the original Statutory PAYGO law) that exclude the budgetary effects of that lawâin whole or in partâfrom the Statutory PAYGO scorecards. Laws that resulted in the largest amounts excluded from the Statutory PAYGO scorecards in Table 1 are reflected in Table 2 . Of note, the list includes both tax cut and spending legislation. Table 2. Exclusion provided in legislation enacted prior to the reconciliation law. See Section 5002 of P.L. 115-96 . Total Budgetary Effects Eliminated from the Statutory PAYGO Scorecards In addition to the previously discussed laws that excluded some or all of their own budgetary effects from the Statutory PAYGO scorecards, five laws have been enacted that eliminated existing balances on the scorecards. For example, Section 8000(d) of the Continuing Appropriations, Agriculture, Legislative Branch, Military Construction and Veterans Affairs, and Extensions Act, 2026 ( P.L. 119-37 ) eliminated all balances on the 2025 scorecards: (d) Balances on the PAYGO Scorecards.âEffective on the date of the adjournment of the first session of the 119th Congress, and for the purposes of the annual report issued pursuant to section 5 of the Statutory Pay-As-You-Go Act of 2010 (2 U.S.C. 934) after such adjournment and for determining whether a sequestration order is necessary under such section, the balances on the PAYGO scorecards established pursuant to paragraphs (4) and (5) of section 4(d) of such Act shall be zero. Figure 2 illustrates how the provision above prevented conditions that would have triggered an end-of-session sequester at the end of the first session of the 119 th Congress. Figure 2. OMB Statutory PAYGO Scorecard for Budget Year 2026 Source: Office of Management and Budget, 2025 Statutory Pay-As-You-Go Annual Report , p. 8. Notes: To calculate the amounts recorded on the 5-year scorecard under the Statutory PAYGO Act, the estimated cumulative budgetary effects of legislation enacted in the second session of the 119 th Congress over the 2025-2030 period ($2,645,601million) were divided by 5 to reflect the annual average ($529,120 million) and recorded as a debit in each year of the 2025-2030 period. To calculate the amounts recorded on the 10-year scorecard, the process was repeated using entries that correspond to the 2025-2035 period. The estimated cumulative budgetary effects of legislation enacted ($4,440,234 million) were divided by 10 to reflect the annual average ($444,023 million) and recorded as a debit in each year of the 2025-2035 period. Pursuant to the directive in Section 8001 of P.L. 119-37 , the balances on the two scorecards were then subtracted to produce zero balances. The budgetary effects eliminated from the Statutory PAYGO scorecards are summarized in Table 3 . In total, between 2010 and 2025, nearly $4.88 trillion was eliminated from the 5-year scorecard and $6.85 trillion was eliminated from the 10-year scorecard. Table 3. Totals reflect the net effect of the balances for all years on the scorecards at that time. The amounts in this table are in nominal dollars, unadjusted for inflation. Sequesters Under the Statutory PAYGO Act Since the Statutory PAYGO Act became law in 2010, legislation has been enacted that was estimated to increase budget deficits, yet to date, a sequester under the act has never been ordered. This outcome can be attributed to the scorecard exclusions required by the Statutory PAYGO law or provided in subsequent legislation, and provisions within new laws that eliminated existing balances on the Statutory PAYGO scorecards . In total, nearly $12.07 trillion has been excluded or eliminated from the 5-year Statutory PAYGO scorecard and $17.07 trillion has been excluded or eliminated from the 10-year scorecard (see Table 4 ). Notes: a. Pursuant to Section 3(4)(A)-(B) of the Statutory PAYGO Act, amounts on the scorecards reflect estimated, on-budget mandatory (direct) spending outlays and revenue effects only. Off-budget and discretionary spending effects are not recorded. Positive amounts (costs or debits) indicate a net increase in the deficit; amounts in parentheses are negative and indicate a net decrease in the deficit (savings or credits). The amounts in this table are in current dollars, unadjusted for inflation. b. This category summarizes the budgetary effects attributable to the current policy exclusions pursuant to Section 4(c) of the Statutory PAYGO Act and the CLASS Act exclusion in Section 4(d)(6). c. Where noted, the amounts in this table exclude from any CBO score the budgetary effects of provisions that extend or modify the mandatory (direct) spending sequester pursuant to section 251A of BBEDCA. This is because the Office of Management and Budget (OMB)âthe agency responsible for determining whether a sequester is in order and calculating the amountâhas determined these provisions do not have any budgetary effect. In the 2015 Statutory PAYGO Annual Report , OMB states "because future sequestration of direct spending is triggered one year at a time under the Joint Committee enforcement procedures, providing an opportunity for future congressional action to avoid these enforcement measures, OMB does not include future direct spending sequestration in the baseline it uses to estimate budgetary effects under the PAYGO Act and extension of direct spending sequestration therefore does not have a budgetary effect for purposes of OMB's PAYGO estimates." d. Most of the modifications to the mandatory sequester result in savings (a credit). Subtracting a credit (subtracting a negative number) from the scorecard is the mathematical equivalent of adding a positive amount. For simplicity, this table reflects that equivalenceâthe table adds back savings attributable to the modification of the sequester. e. For more information on the direct spending sequester in section 251A, see CRS Report R48880, The Annual Mandatory Spending Sequester Through FY2033 , by Drew C. Aherne. Footnotes 1 . 2 U.S.C. §931-939. 2 . P.L. 111-139 . For a detailed description of the legislative history of Statutory PAYGO, see CRS Report R41157, The Statutory Pay-As-You-Go Act of 2010: Summary and Legislative History . Statutory PAYGO is distinct from the Senate's PAYGO rule. The latter is a procedural rule enforced via a point of order (if raised) during consideration of a measure on the Senate floor. 3 . Pursuant to Section 4(e) of the Statutory PAYGO Act, any current-year costs are also included in the budget year, so that the law effectively records the budgetary effects of legislation over 6-year and 11-year periods. 4 . For example, in 2024 (the second session of the 118 th Congress), the statutory PAYGO scorecards covered FY2025-FY2029 and FY2025-FY2034. For 2025 (the first session of the 119 th Congress), the years covered by the scorecards advanced one year to cover FY2026-FY2030 and FY2026-FY2035. 5 . The term "budget year" means, with respect to a session of Congress, the fiscal year that starts on October 1 of the calendar year in which that session begins. For example, the budget year for the second session of the 119 th Congress (which began January 5, 2026) is FY2027. See Section 250(c)(12) of the Balanced Budget and Emergency Deficit Control Act of 1985 ( P.L. 99-177 , as amended). 6 . Section 8 of the Statutory PAYGO Act adopted the sequestration-related procedures enumerated in the Balanced Budget and Emergency Deficit Control Act (BBEDCA, P.L. 99-177 , as amended) but also amended those procedures. Section 10 of the Statutory PAYGO Act capped BBEDCA's uniform percentage reduction to Medicare provider payments under Parts A and B to 4%, and Section 11 updated and expanded BBEDCA's list of mandatory spending programs that are exempt from sequestration. 7 . Section 7 of P.L. 111-139 . 8 . Section 4(d)(6) of P.L. 111-139 . 9 . Section 4(g) of P.L. 111-139 . 10 . Of these 82 measures, 7 included provisions excluding Statutory PAYGO effects from the scorecards but were later determined by OMB not to have any such effects. Separately, 2 laws have been enacted (between 2010 and 2025) that included exclusion provisions, but the budgetary effects were characterized wholly as discretionary spending and were not recorded on the Statutory PAYGO scorecards.
