Freedom: An Emergent Property of Just Systems
Standard accounts of freedom—negative liberty (non‑interference), positive liberty (rational self‑direction), republican liberty (non‑domination), and social freedom (recognition)—all miss a crucial dimension: the institutional conditions under which informed agency becomes possible. This paper argues that freedom is not a pre‑social endowment that institutions merely restrict, nor an attribute of isolated individuals. It is an emergent property of persons within just institutional systems—a property that arises from the dynamic interaction between developing persons and the systems that scaffold their agency. Freedom emerges when institutions satisfy six constitutive conditions: Visibility, Symmetry, Contestability, Repair, Education, and opportunities for productive activity sufficient to secure the material requisites of flourishing. The first five conditions develop and sustain informed agency; the sixth secures the material conditions necessary for exercising it. Freedom therefore belongs neither to the individual alone nor to the institution alone. It is a property of persons functioning within just systems—a state that emerges when the parts (persons and institutions) work together successfully. The paper applies Ockham's Razor to show that freedom, like rights, need not be posited as a foundational entity or motivational power. The burden of proof shifts to those who claim otherwise. The paper concludes that the free also care: freedom is not freedom from interdependence but freedom to perceive and respond to interdependence with clarity and care—the natural expression of which is the vow‑motive.
