Black family history has often survived through materials that public institutions treated as secondary: family Bibles, photographs, funeral programs, letters, quilts, recipes, oral histories, church registers, burial knowledge, and fragments copied from courthouses. This paper argues that such materials constitute archives of survival—intimate systems through which families preserve relation, personhood, place, and obligation under conditions of slavery, segregation, migration, dispossession, and administrative exclusion. The normative problem is not whether all family memory should be accepted as fact. It is how courts, archives, museums, genealogists, and public agencies should evaluate intimate evidence without reproducing the hierarchy that helped create documentary absence. Drawing on Tiya Miles’s analysis of Ashley’s sack, Black feminist accounts of homeplace and the archive, federal evidence rules recognizing family and community history, USDA reforms for heirs’ property operators, and museum preservation programs, the paper develops evidentiary pluralism: different forms of evidence should be assessed through provenance, proximity, independence, continuity, and consequence rather than ranked solely by institutional origin. It also defends preservation without possession, custodial humility, descendant standing, and contextual integrity. The paper concludes with an eight-part Intimate Evidence Protocol designed to support preservation, legal use, digitization, and public access while protecting family control and the right to opacity.
