Justice
This chapter, drawn from the author’s book manuscript Noura: Justice, Flourishing, and Commonwealth, develops an empirical, developmental, and institutional account of justice. It argues that the dominant liberal tradition, from Hobbes through Locke, Nozick, and Rawls, begins from a foundationally mistaken anthropology: human beings are treated as already constituted agents whose potentially conflicting interests political institutions must coordinate or constrain. Human beings are instead developing, relational beings whose cognitive, moral, and agentive capacities emerge through care, education, material provision, and institutional scaffolding. Justice must therefore be understood not primarily as a set of principles governing already constituted agents, but as a systemic property of institutions that enable informed agency and flourishing. The chapter defines justice as the emergent property of a revealing-form system that maintains dynamic symmetry among informed agents who flourish. It identifies six constitutive conditions of such a system: Visibility, Symmetry, Contestability, Repair, Education, and Material Requisites. The first four provide the scaffolds of outcome symmetry; the latter two develop and sustain the capacities and conditions required for meaning-making and informed agency. These conditions specify the invariant deep structure of justice rather than a particular political form. Different societies may instantiate them through substantially different institutional arrangements, making the appropriate surface forms of just institutions a matter for empirical investigation, comparison, experimentation, and institutional learning.
