AAI-01 - Delegation Is Not Distribution

philosophy
Contemporary debates on agency and responsibility share a recurring assumption: that spreading decision-making across multiple actors preserves accountability. This paper argues the assumption is false, and that the confusion sustaining it rests on a structural distinction that has gone unnamed. Delegation and distribution are not the same thing. Distribution preserves custody — the capacity to interrupt, veto, or reclaim a decision before it closes. Delegation transfers custody to a system no participant can fully halt. Humans remain present, contributing inputs, approving outputs. But the point at which a decision becomes irreversible lies elsewhere, beyond reach. When custody leaves human hands, responsibility does not become collective. It becomes orphaned. The rituals of accountability continue — oversight committees, compliance audits, human-in-the-loop protocols — while the architecture that would make them meaningful has already foreclosed. The paper argues that human-in-the-loop is not a moral safeguard but a positional description. Presence is not authorship. Approval is not custody. Until this distinction is recognized, discussions of responsibility will continue to locate blame where enforcement is possible rather than where decision actually occurred.
