Master of Law, Faculty of Law, Universitas Diponegoro Description The International Criminal Court (ICC) was established as an instrument of international law to enforce accountability for the most serious international crimes, including war crimes. The armed conflict in the Gaza Strip involving Israel and Hamas has once again placed the ICC at the center of international attention after the ICC Prosecutor submitted applications for arrest warrants against leaders of both parties. This step generated controversy because it raised allegations of jurisdictional politicization influenced by the interests of major powers, particularly the United States, which historically maintains a strategic relationship with Israel (Schabas, 2021). This research aims to analyze how ICC jurisdiction is exercised in the context of the Gaza conflict and how international political factors affect prosecutorial independence in war crimes cases. The research employs normative legal research with a qualitative approach through the analysis of international regulations, the Rome Statute, international court decisions, and relevant legal literature (Cassese, 2013). The findings indicate that ICC jurisdiction formally possesses legal legitimacy based on the recognition of Palestine as a State Party to the Rome Statute, yet the implementation of that jurisdiction faces significant political obstacles. Diplomatic intervention by major powers has influenced perceptions of ICC neutrality in carrying out its mandate. This condition demonstrates that the effectiveness of international criminal law remains highly dependent on global power configurations. Strengthening the institutional independence of the ICC has become an urgent necessity to preserve the legitimacy of international law enforcement.
