Academia Nacional de Ciencias Description El presente artículo ofrece un análisis jurídico-documental de la situación humanitaria y las violaciones del derecho internacional en la Franja de Gaza desde el 7 de octubre de 2023 hasta marzo de 2026, enriquecido con los aportes doctrinarios contenidos en la obra Razones que matan. Globalización y Derechos Humanos (Pablo R. Banchio, Forum Accademico , Buenos Aires, 2024). Se examinan cuatro bloques normativos y probatorios: (i) el empleo documentado de armas de alta temperatura y fósforo blanco; ( ii ) las estimaciones epidemiológicas revisadas por pares sobre mortalidad directa e indirecta; ( iii ) la actualización humanitaria acumulada al 11 de marzo de 2026; y ( iv ) la acción de los principales tribunales internacionales - Corte Internacional de Justicia ( CIJ ) y Corte Penal Internacional ( CPI ) - . El análisis integra nuestra crítica filosófico-jurídica sobre la "inversión de los derechos humanos", la instrumentalización geopolítica de la retórica humanitaria y el concepto de "razones que matan" como mecanismo discursivo de legitimación del exterminio, confrontándola con los estándares normativos del Estatuto de Roma, los Convenios de Ginebra y la jurisprudencia internacional. Abstract (English) W AR CRIMES AND GENOCIDE IN GAZA (2023–2026) Analysis from the perspective of international human rights law, international humanitarian law and the jurisdiction of international courts This pap e r offers a legal-documentary analysis of the humanitarian situation and violations of international law in the Gaza Strip from 7 October 2023 to March 2026, enriched by the doctrinal contributions in the work Razones que matan . Globalización y Derechos Humanos - Reasons That Kill. Globalisation and Human Rights - (Pablo R. Banchio, Forum Accademico , Buenos Aires, 2024). Four normative and evidentiary frameworks are examined: ( i ) the documented use of high-temperature weapons and white phosphorus; (ii) peer-reviewed epidemiological estimates of direct and indirect mortality; (iii) the cumulative humanitarian update as of 11 March 2026; and (iv) the action of the main international tribunals - the International Court of Justice ( ICJ ) and the International Criminal Court ( ICC ) . The analysis integrates our philosophical-legal critique of the 'inversion of human rights', the geopolitical instrumentalisation of humanitarian rhetoric, and the concept of 'reasons that kill' as a discursive mechanism for the legitimation of extermination, confronting it with the normative standards of the Rome Statute, the Geneva Conventions and international jurisprudence.
