The Criterion Problem
Skarbek (2026) argues that qualia do not function as a justified explanatory posit and that the hard problem of consciousness is an artifact of an unjustified conceptual transition. This paper accepts much of Skarbek's analysis but argues that his conclusion depends on a commitment he does not defend: that only third-person evidence counts as evidence. His three diagnostic criteria — causal role, distinguishable difference, and conditions of application — are presented as ontologically neutral, but each requires that a concept's contribution be evaluable from outside the subject's own perspective. This is a substantive position in epistemology, not a minimal constraint on explanation. The paper argues that direct acquaintance constitutes a legitimate epistemic ground that Skarbek's framework does not address, and that the hard problem survives the dissolution of the concept of qualia because the phenomenon the concept attempts to capture — the gap between what can be described from outside and what is experienced from inside — precedes and is independent of the concept. The paper further offers a proof of physical possibility: a scenario in which consciousness acts at quantum-indeterminate decision points, its effects are amplified through chaotic neural dynamics, and its contribution is principally unmeasurable from outside — not due to technological limits, but due to the structure of physics itself. This does not establish the mechanism, but it defeats Skarbek's causal dilemma by demonstrating a third option he does not consider: something distinguishable from the inside and indistinguishable from the outside.
